i have previously given a witness statement for my parents on a accident claim. now i am unable to remember the facts of the incident and a court summons has turned up for me to attend court to give evidence can i withdraw my statement|||You can, but there's no need. You'll just have to say 'I don't remember' and they'll take your witness statement as a record of what happened.

This should jog your memory. If you are asked questions about things which you can't remember, just say so. But don't try to withdraw your statement. It sounds like what you really want is to get out of testifying in court. In order to do that, you will have to move to quash the summons. Basically, you need to convince the court that the value of your testimony would be outweighed by other concerns. However, it sounds like the party other than your parents issued the summons, and this party may want your testimony for reasons other than your recollection of the accident.|||No....but you will be shown your statement before the hearing so that you can refresh your memory....they can still call you as a witness....you are not a complainant, so you cannot withdraw a complaint...don't panic....if you don't remember something in court, simply say you don't remember.....
